By Thomas's own "history and tradition" reasoning, such as it is, he is still a slave and his marriage to a White woman is illegal. How about addressing that, Clarence?

Exactly, this is some of the most pathetic kinds of rote applications of "originalism" imaginable.

If Clarence Thomas has a lineage that goes back to early Virginia, then he could belong to ME God damn it! Give me my property back!

What a meaningless response. You should withdraw or apologise for your racist Jim Crow era remniscent joke and your openly misogynist words about his wife which are nothing to do with her politics and everything to do with her gender. This kind of insulting and pathetic language does not belong on Mr Truscott's page. His analytical writing and 100% of his responding commenter's words don't flail around in this gutter level of puerile racial and gender based insults which is why I'm reacting to your comment with approbrium. I appreciate Mr Truscott's and Mr Truscott's responders' intelligent, reasoned and respectful analyses and yours, presumably pretending to be jokey and witty, don't fit into that category of discourse, at all.

Rs/cons are to a person cherry-pickers and insist they can square a circle of their own making.. No exceptions. Couldn't stop chuckling at CJ Roberts rebuke of lower courts for reading Bruen...literally. Then the kicker of citing long-held liberal arguments of muskets and sabres in the time of the framing. Of course, the irony of his words run smack dab into his vote not to ban bump stocks. In this case, no one was killed, yet in the Vegas massacre 58 were killed and circa 500 wounded or injured.

So, in less than 2week the conservative majority minus one has been all over the map on all-things guns. And this case revealed how foolish any argument of tradition and history is.

As to Thomas marrying a white woman: Have encountered my share of POC who think, act, and behave as if they were yt or white. There is a litany of colorful names for those folk. In my culture, one common name for them is apples, red on the outside, white on the inside. As to slavery, keep in mind Thomas bragged he spends his summers on the road in "his" RV and using Walmart parking lots to be with ordinary folk. How noble, if it were true. Instead he is a slave to the mega rich, as their token Negro who will do as he is commanded. Doubt they would have given him a 2nd look had he married a WOC.

Trivia: Thomas and John Roberts wife both attended and graduated from the College of the Holy Cross. Thomas and Roberts are very close.

The entire concept of "originalism" plays more like a bad Twilight Zone episode than a serious legal theory. It's amazing that judges who do this work for a living can espouse it with a straight face. It's whole purpose relies on pretending the last 250 years of society never happened and we're living happily on a plantation economy. As Linda points out I don't think that Clarence has thought the repercussions through.

I have no illusions about that!

It's terrifying this knucklehead and Alito are on the United States Supreme Court.

LKTiv:

“Some courts have misunderstood the methodology of our recent Second Amendment cases. These precedents were not meant to suggest a law trapped in amber,” Roberts wrote.

They sure as hell were intended to suggest a law trapped in amber. You just got embarrassed when some of the consequences came to light, Mr. Chief Justice. And you approved the decisions that trapped the law in amber, or else you're out of the loop.

I will bet real American money that you'll rule back with the 17th century fools, next time you have a chance. That's what you consistently do, after throwing us lefties a morsel: Give a little, take a lot -- it's a vicious pattern on the Court these days.

When, oh when, are justices and lawyers who rely on “laws as they were” in 1791 going to look also at the weapons to which those laws applied? Ok, let that wife-beater have his weapons: but let them be muzzle loading, black powder firing, flint ignighting, HEAVY PISTOLS of that time!!!! You can’t have history and it’s laws on your side only when you win (which seems to be the Trump/MAGA doctrine) and ignore it the rest of the time. Bullets weren’t even invented until the mid 1800s. Automatically firing weapons came much later!!! Ever tried to shove a Gatling gun into your pant belt? You’d have to be a much bigger man than “Justice” Thomas to do

that.

A detail, perhaps, but bullets go back to the 1400's. Check this site out:

I really can’t deal with Thomas’ ridiculous reasoning. That he even uses the words stating that laws for dealing with gun violence , made at the time of the founding of this nation, are of course , the solution in 2024 is BS . I don’t believe that he believes this either .

He’s been exposed as a grifter and he blames ‘ the nasty mean people in Washington , DC ‘ for objecting to his flagrant violations regarding accepting gifts worth billions from Conservatives w business before the Court.

He is expanding his hissy-fit behavior just to let people know he won’t stand any Criticism.

So he’ll pout and dig in his heels because apparently no one has the right to disagree with him.

He’s wrong on this one .

Let’s add a little free floating common sense to the mix

Domestic abusers should not be allowed to have weapons. Period.

Not hard . Common Sense .

The words written in the late 1700’s regarding a man’s right to bear arms , should be able to questioned at this time in our history .

Where more people die from

Gunshot wounds than any other country. Value your interpretation or value life . Of adults , kids and old men.

Common sense.

I didn’t see any problem with trashing the Constitution when Trump , who attempted a coup

On these United States on Jan 6 , was allowed the option to violate the clear words of the 14 th Amendment, regarding government officials who have taken an oath to defend and protect the laws of the land, decides not to .

It’s pretty clear to most of the people in this country.

Trump should be disqualified from running again for the Presidency because he violated his oath of office.

Not hard . The MAGA justices fell all over themselves making up excuses to not apply this law to Trump.

Their Error.

I imagine that Thomas is proud of himself for standing up for principle -- the deranged principle he created in Bruen -- rather than succumb, as the eight others did, to a soft-hearted concern for women who are being murdered. The law is the law, after all. We serve it; it does not exist to serve us.

I agree but I also feel that somebody who has bought him made the final decision.

Yes, it’s true. I find Thomas despicable.

Justice for Sale

In the alley's dark, history's cursed trade,

Man of onyx sold to the highest blade.

Old whips' kin, wallets fat with sin,

Bought his silence, fire deep within.

He strode to the block, a grin on his face,

Gold and promises, his skin's disgrace.

Greed's bleak light, soul stripped bare,

Pride exposed for trinkets they’d spare.

Cold manacle round his throat,

Followed demons, barely afloat.

No rebellion, nod and smile,

Gold's gleam made chains worthwhile.

Obedient, bowed, spirit on lease,

Traded fire for a slice of ease.

In grotesque carnival, liberty sold,

Knelt to command, lusting for gold.

In damned land, shadows reign,

Willing slave, bound by greed’s chain.

Testament to the cycle’s cruel spin,

Chose yoke, sold out for sin.

Clarence Thomas, gifts received,

Justice for sale, public deceived.

Highest court, seat betrayed,

Honor lost in gold's charade.

Supreme robe, sullied, torn,

Sold decisions, loyalty sworn.

Betrayed the bench, ethics slighted,

For greed's glare, justice blighted.

Dark alley deals, shadows cast,

Integrity lost, his soul harassed.

Highest bidder, bought the court,

Justice crumbled, sold and bought.

I love the Constitution. I love

reading the Federalist Papers

and how these men, "240

years ago" brought forth the

standards in our Constitution.

But that was 240 years ago.

They NEVER envisioned the

country we all live in today,

or the 3 branches of

government they thought

would protect and live by

the "standards" of the Constitution. Especially

SCOTUS.

They NEVER envisioned the

weapons we have today. That

we're licensed, or not, to

carry and kill each other for

whatever reason you woke up

with.

I think originalism of the

Constitution is a great thing

to study. I don't think, believe

or feel, SCOTUS should base

decisions for 2024, especially

on guns, on the "original

context" of the 2nd

Amendment written 240

years ago and enshrine

them as laws of the land.

Wow. The hypocrisy and irony of “Clearance” Thomas’s dissent just can’t be denied here. How is it possible that he doesn’t recognize that the “history and tradition” of laws during the founding of this country would have him trapped in the iron manacles of slavery and likely lynched for even touching his white wife?

On similar note, now I know what’s behind the commonly used “rule of thumb” phrase and will NEVER utter those words again.
