LKTIV, thank you for saving me, and i'm sure many others, from having to hack thru the legalese.

i value your synopses on these weighty judicial issues over which my mind quickly grows numb.

on cases such as this, doesn't the CDC have a bank of lawyers to proficiently attack such an ill construed judgement?

is this 8-years-out-of-college freshly cloaked judge allowed to freely press her personal bias upon the rest of the population?

how about others who may be immediiately impacted by relaxation of masking, like the flight attendants and other airport workers who have to deal face to face with snot-drivelling travellers?

and doctors and nurses who have to care for increased loads of patients?

don't they have someone representing them in court?

or the teachers' unions whose members have to deal with sniffling and coughing youngsters?

wasn't there any objection or counter argument raised against that fresh-out-of-school judge?

i don't expect or need you to have answers to these questions, LKTIV, i very much appreciate this chance to vent at this issue you have put to us.

stay safe and healthy

Judge Mizelle is just playing a word game. Instead of addressing the law in its entirety she picks words and phrases that have more than one meaning and assigns them a meaning other than the clear intent when considered in the context of the whole. If I had turned in an essay like that to my high school sophomore civics teacher, he would have handed it back to me with a big red letter "F". Judge Mizelle's opinion is "sophomoric", another word that has more than one meaning.

Perhaps, in possessing all three qualities, the individual in question deserves a new sub-species descriptor? Sophomoronic.

Yes, she was rated "not qualified" by the American Bar Association, which is clearly on display in this case.

When writing her opinion she forgot to use one important method of developing a conclusion: common sense!

Common sense is the enemy of these people out of their qualification league. "Common sense" is just too "common" for them. They prefer the exclusivity of stupid. (Unfortunately, stupidity is spreading across the country, faster than their hated "creeping socialism.") Common sense will only lead to the "common good," and who cares about that "Communistic" theory in a one -percent dominated world?

I taught Paralegal students and Criminal Justice students at a 2 year college introducing to Law (legal reasoning and writing) and Constitutional Law (mostly Civil Rights). - long time ago - if I had a student in one of my classes write a brief like that - it would have been graded F.

Oh this was a joy to read—I laughed out loud when I read “but that would be unfair to nits.”

I want to know when the medical establishment is going to charge these inept Repug legislators with practicing medicine without a license. It USED TO BE that professional expertise was consulted before enacting policies —researched, medical, licensed opinions allowed for responsible governance.

How the hell did she get through law school with that thought process? I’ve already taken three ibuprofen and a tramadol plus two gabapentin. It can’t kick in soon enough.

Only for hugh school and her BA. She was summa cum laude from U of FL Law School.

53pp from this legal genius? The only thing I read that she found masks viable for was preventing droplets from spreading from person to person or surface. WELL...DUH!!!!! OMG...skip the ibuprofen and naproxen. Cross the river into NJ where we can meet at the nearest cannibis dispensary! Sorry cannabis. It's late.

It's the old phrase that works here: "I would have made it shorter but I didn't have time." Or intellect.

Love this assessment.

Is she one of those "for life" robes? May we hope she travels and her seatmates are all infected and that she is an anti vaxxer? If she cannot be debenched through legal means, then KARMA might be the remedy. What a dufus.

And there weren't even any oral arguments. Is that the way the RW will settle disputes now - throw out cases they hate? How does that square with judicial procedure? Guess that's their version of judicial restraint, eh?

Thank you for sorting this BS. I don't like sticking my head in a bucket of shit. I remember something the Supreme Court said in 1906 concerning the smallpox vaccine law. You have no right to infect and kill others.

Last week I returned from Europe on a nearly full United 787. A nearby flight attendant had to ask a customer to wear a mask. There was no fuss, fortunately.

If I worked in transportation I would really like customers to consider my health and safety.

Anyone who has been overseas in the past few years knows how considerate folks in other countries are.

On a Viking River journey last week we were tested daily while on board. No sweat.

Thanks, Lucien, for the summary. I am happy to know there are judges like this protecting me from the overreach of science and factual data so I may continue to operate independently of any responsibility to my fellow citizens. Some of them are so boring I am sure I will not miss them as I blithely continue my walk of life toward freedom and liberty from the oppression of The State. Call it the Darwin Effect.

But, I digress. What I want to emphasize is this woman who was appointed by one DJ Trump and who was elevated to her seat with a confirmation of the Senate Judiciary Committee headed by one Lindsey Graham with lots of references from the Federalist Society was given a "Not Qualified" rating by the ABA. Once again proving the GOP is the party of opportunity willing to overlook the annoying interference in our political process by institutions which would continue to resist the will of the masses to have someone who is just like them sit in judgement.

The way I see it, her ruling makes perfect sense to those who now identify as Republican. There is no need for reliance on science or logic; they are simply excuses to put in place a bureaucracy which denies me my free will. We only need government to protect us from the real threats to the Republic such as CRT, White Replacement Theory and George Soros.

She is now a leading candidate for a SC seat should Trump win election and there be a vacancy. She will join the likes of her mentor Clarence Thomas and John Roberts, the latter who in helping to strike down the Voting Rights Act so accurately pointed out there was not a need for it since there was no longer racism in the nation.

Now if you will excuse me I have to Purell my hands again. That is all the protection I need.

Absurd is the word I think.

Why should the surgeon wash hands, wear a mask , work in a damn cold room? It's as if Lister never lived.

By the way , I don't have to wash my hands before returning to work and preparing and serving your food. And you cannot make me.

A little about me. I have stage four pancreatic cancer. Will probably need to wear a mask the rest of my life, however long that may be. I've been dead man walking for almost three years now.

I am a little tired about the whining of wearing a mask, getting a shot etc. I would not wish what I have on my worst enemy, but what if it was communicable and I refused to do anything to help prevent the spread?

Grow up. Be big boys and girls. And stop whining. You could be living in Ukraine. A little Covid plus invasion and war.
