Celebrations among Democrats are taking place in Pennsylvania and North Carolina this week after the Supreme Court refused requests by Republican legislatures in those states to reinstate congressional district maps which had been overturned by state courts. In North Carolina, the Republican-controlled legislature had drawn a map which would have enabled Republicans to win 70 percent of congressional seats in a state where voter registrations are evenly divided between Democrats, Republicans and Independents. In Pennsylvania, the state Supreme Court approved a map that would have given Democrats two more congressional seats than Republicans. The Republican-controlled state legislature asked the Supreme Court to intervene and reinstate a map they had drawn that would have resulted in one less Democratic congressional district.
"States' Rights" is just French for state-enforced bigotry and misogyny, and always has been. The conservatives on the Court are nullifying the results of the Civil War.
What are the steps for removing a member of SCOTUS? If the courts are not going to be expanded, then those sitting in those seats wearing those black robes and undermining our Constitution have obviously violated their oath and need to go.
Republicans won’t be happy until the Federal Government is dismantled and the States have unfettered license to do as they please.
States rights went the way of the dinosaur after the Civil War.
America went from the united States to the United States.
The Constitution gives the Federal government ultimate control.
Today’s SCOTUS is bound and determined to return the country to the days when states were autonomous, beholden to no one except when they want tax dollars for local boondoggles.
actually, states rights went nowhere after the Civil War. they just "hibernated" for about twelve years, after which we had nearly a hundred years of Jim Crow. which the Supreme Court had no problem enshrining as law for well over fifty years in the infamous Plessy decision.
Agree, Lucien. This is right out of the Federalist Society playbook. The doctrine of states rights will return the nation to a time when not all men (or women) are created equal . To a time when a landed/monied ruling class can dictate to the citizens in each state what it believes is in their best interests. And a time where it will be difficult if not impossible to be "united" on anything.
If we do go this way it will be no one else's fault but our own. We can blame the right until the cows come home but the truth of the matter is we, as in we the people, have taken our democracy for granted for far too long a time. Many of us assumed things would never change and we didn't have to participate. When you see the participation rate in elections range from only 50% to 70% that tells us almost half of us have voluntarily checked out and do not see the merit in participating in selecting who is supposed to represent our interests.
Those who do not participate have a lot of excuses and rationale for not doing so. "I was too busy;" "I can't get off work;" "My vote doesn't count;" "I am only one person, what difference will my vote make;" and on and on and on.
One reason public opinion polls have become so erratic is people lie, yes, lie when polled. They either tell you what they think you want to hear, what is "acceptable" or what their friends have told them to say. But, what has remained constant is the fact those who do not vote also tend to be the ones who -tch and moan when things are not going so right for them. I am afraid we, as a people , have come to believe it is someone else's job to carry our water. If this Court continues on its current path a lot of us are going to find not getting out of bed on election day was the most expensive day off we ever took.
most of the people I associate with (and me as well) believed for the longest time that Whig historians had it right and that history was going to show some kind of slow, but consistent "progress" toward greater equality, more freedom, less stupidity, etc. we were obviously wrong, and should, at very least, have had some kind of "Plan B" somewhere in our common (I avoid "collective" because of the various cans of worms that term can sometimes lead to) consciousness. but I sure didn't.
You know something? If I wanted to read Heather's commentary on my page, I would have quoted her. She's doing well enough on her own without free advertising for her newsletter on my page.
They learnt from Scalia who interpreted the constitution in such a way that gun deaths in America can never be controlled. They will make America like Pakistan. A religious state full of gun totting haters.
He was probably the most poisonous justice since Taney; originalism is the judicial equivalent of Secret Sauce; it's The Experiment That Cannot Be Replicated, and Heller may be the single worst decision since Korematsu (at least until Citizens United and Shelby County). That shit defies explanation, and for a woman judge to pretend to originalist thinking (originally, she wouldn't have a vote or the chance to serve on the bench; really, how hard is this?) is past weird.
Amy crony Barrett along with trump had people executed at trumps end of office because they knew Biden would not kill them. The pope is ambivalent about abortion but is extremely against states killing people. Biden is closer to his religious leader the pope than Amy so what do republicans do lie, about it. As usual.
I’ll spend tonight re-reading “The Handmaid’s Tale” as it becomes the female instruction manual. I’m hoping my girls (daughters, daughter-in-law, and granddaughters) never EVER allow their states to be usurped by the arselingtons! Maybe we all live in the northeast for a reason. I’ll need to take refugees from Texas and Florida as they continue to tighten the noose around humanity. (Thank you for giving me a breather from the horror in Ukraine, albeit far from pleasant!)
"States Rights" in our land always means...restricting who can vote--taking away the "rights" of others to participate in democracy. I would like the federal government to protect my right as a woman to be able to control my own body--and not give that up to some jerk who is blathering on about--"states rights."
Are we, The People, in a paralytic state? Are we completely powerless when it comes to these judges? They dangled a carrot for the Dems in NC and PA. Then granted them a win but with a caveat that they will “consider” arguments still. What a roller coaster ride! Quite frankly, Thomas should recuse himself from any and all rights to make any decisions based on his wife’s illegal activities.

The GOP is winning

You're right on, Lucian. This is getting buried in all the war news, but the ramifications are ominous.
The next insurrection will be wrapped in a flag and carrying a cross.

Oh sorry. I didn't realize this was like that. For the record, I promote your newsletter whenever I can.
Huh?
Good commentary, Lucian.

Thank you for fleshing out my point.

Also his lying to Congress in his confirmation.
